After a long fight, we secured a huge victory this week. Beal & Hebert is proud to be part of the legal team representing homeowners in a high-stakes lawsuit against D.R. Horton, one of the nation’s largest homebuilders. A Louisiana judge rejected D.R. Horton’s attempt to force arbitration, ruling that the arbitration clause in the sales contract is not legally binding or enforceable. This means the case will remain in state court, where our Youngsville clients can present their case to a jury.

The lawsuit alleges D.R. Horton sold them a home with serious construction defects, including mold, water intrusion, and an HVAC system unfit for Louisiana’s humid climate. Judge Donald Johnson found material inconsistencies in the sales contracts and ruled that the builder failed to properly execute the agreement, making arbitration unenforceable.

This is a big step forward in holding builders accountable—and we’re not done yet. The decision could open the door for hundreds of other Louisiana homeowners affected by similar issues to finally seek justice. At Beal & Hebert, we remain committed to fighting for those impacted by negligent construction and unfair contract practices. Thank you to the incredible homeowner team and the court for standing strong—justice is within reach.

If you or someone you know has purchased a defective home and feels trapped by an unfair arbitration clause, contact Beal & Hebert today. As Acadiana’s Hometown Lawyers, we’re here to protect your home, your rights, and your future.
